Consumer Terms

1. Operator and agreement

These Terms are a contract between you and Bryan Duerk, an individual doing business as WanderBunnies ("WanderBunnies," "we," "us," or "our"). Our address is 4 Dickinson Circle, Shrewsbury, MA 01545, USA. Customer support is available at support@wander-bunnies.com or bryan.duerk@gmail.com.

By creating an account or using the Service, you agree to these Terms and the Privacy Notice. If you purchase a subscription, the order confirmation and plan details are also part of the contract. If you do not agree, do not use the Service.

2. The Service

WanderBunnies provides digital tools for planning and collaborating on travel, including itineraries, trip information, shared expenses, communication, document and email ingestion, location search, and AI-assisted recommendations. Features, limits, integrations, and availability may differ by plan, platform, country, or provider.

WanderBunnies is not a travel agency, carrier, hotel, tour operator, ticket issuer, insurer, medical provider, immigration adviser, or emergency service. A link, recommendation, or imported record does not create a contract between you and WanderBunnies for the underlying travel product.

3. Eligibility and accounts

You must be at least 16 and legally able to enter this agreement. If you use the Service for a child or invite another person, you must have authority to provide their information and accept these Terms on their behalf where required.

You must provide accurate information, protect your credentials, promptly report unauthorized access, and remain responsible for activity under your account. We may require email verification or additional security checks.

4. User content and collaboration

You retain ownership of content you submit. You grant WanderBunnies a limited, non-exclusive, worldwide, royalty-free license to host, reproduce, transform, analyze, display, and transmit that content only as necessary to operate, secure, support, and improve the Service and provide the feature you requested.

You represent that you have the rights and permissions needed to submit the content and authorize this processing. You must not upload confidential, unlawful, infringing, malicious, or sensitive information that the feature does not require.

Content placed in a shared trip may be visible to the trip's members and may remain relevant to other members after your account or membership ends. Do not share information with a group unless you accept that visibility.

6. AI and travel-information disclaimer

Important: AI-generated and imported travel information may be inaccurate, incomplete, stale, or unsafe. Verify opening hours, prices, availability, reservations, accessibility, border and visa requirements, travel advisories, weather, transport schedules, health requirements, and safety information with authoritative sources before relying on them.

AI output is not professional, medical, legal, immigration, financial, or emergency advice. Do not rely on the Service to make urgent or safety-critical decisions. If you interact with an AI chat feature, the Service will identify that interaction where required by law.

7. External services and affiliate links

The Service may use or link to Google Maps and Places, Gmail, Stripe, AI providers, email providers, Sentry, GetYourGuide, and other third-party services. Their own terms, privacy notices, prices, availability, and cancellation rules apply when you use them.

Some links are affiliate links. We may receive a commission if you make a qualifying purchase, at no additional cost to you. Affiliate status does not guarantee that a recommendation is suitable, available, or the lowest-priced option.

8. Paid plans, subscriptions, and billing

Paid plans are described at checkout. Before purchase, we will show the plan, price, currency, taxes where known, billing interval, trial or introductory offer, renewal terms, cancellation method, and material limits. Stripe processes payments and may provide its own payment, tax, fraud, and privacy notices.

Unless the checkout states otherwise, a subscription renews for the same billing interval until cancelled. Cancellation stops future renewal and does not necessarily create an immediate refund for the current period. You may cancel through Account Settings > Subscription > Manage Billing > Cancel Subscription or the payment portal identified at checkout.

Nothing in these Terms limits mandatory rights relating to withdrawal, refunds, digital-service conformity, defective performance, unfair terms, or other consumer protection laws. See the Withdrawal Form.

9. Statutory consumer rights

If you are a consumer, you retain the legal guarantees and remedies that apply in your country. For EU/EEA distance contracts, a 14-day withdrawal period may apply, subject to statutory exceptions. If you request that a service begin during that period, you may owe a proportionate amount for service supplied before withdrawal; where the law permits withdrawal to be lost for digital content or completed services, we will obtain the required express consent and acknowledgment.

Digital services must meet applicable requirements of conformity, functionality, compatibility, continuity, and security. Contact support@wander-bunnies.com promptly if the Service does not conform.

10. Changes and availability

We may update these Terms for valid reasons, including changes to the Service, law, security requirements, or third-party providers. If a change materially affects your rights or a paid Service, we will provide reasonable advance notice by email or through the Service. Where required by law, we will request your agreement or allow you to terminate before the change takes effect. Continued use will constitute acceptance only where that method of acceptance is legally valid.

We may make reasonable changes to features, integrations, security, and presentation. If a change materially reduces a paid service, we will provide notice and any remedy required by law. We may suspend features for maintenance, provider outages, security, fraud prevention, or legal compliance. We do not guarantee uninterrupted or error-free availability.

11. Indemnification

If you use the Service on behalf of a business, that business will indemnify WanderBunnies against third-party claims and reasonable direct losses caused by its unlawful content, material breach of these Terms, or infringement of another person's rights. If you are a consumer, you are responsible only to the extent that a loss was directly caused by your intentional or negligent unlawful conduct or material breach, and no indemnity applies where prohibited by mandatory law.

12. Accessibility

We aim to make the Service usable with assistive technologies and accessible interaction patterns. If you encounter an accessibility barrier, contact bryan.duerk@gmail.com with the page, feature, device, and assistive technology involved. We aim to acknowledge reports within two business days and provide a substantive response within ten business days.

13. Content moderation and account action

We may remove, restrict, preserve, or report content and suspend or terminate accounts when reasonably necessary to address illegal content, safety threats, rights violations, abuse, security risks, payment fraud, repeated Terms violations, or legal obligations. We aim to act proportionately and provide notice and reasons where legally and practically possible.

Our detailed notice, action, reason, and appeal process is in the Content Moderation and DSA Procedure. Mandatory consumer remedies and rights of appeal are not waived.

14. Termination

You may stop using the Service and delete your account through Account settings. We may terminate or suspend access for the reasons in Section 13, with any notice, refund, data-access, or other remedy required by law. After termination, provisions concerning payments owed, user content, intellectual property, privacy, disclaimers, liability, disputes, and lawful record retention continue as necessary.

15. Intellectual property

The Service, software, branding, design, and materials provided by WanderBunnies are owned by or licensed to the operator. Except for the limited right to use the Service under these Terms, no ownership or license is transferred. Feedback may be used to improve the Service without compensation, provided it does not identify you or disclose your confidential content.

16. Liability

To the maximum extent permitted by law, WanderBunnies is not liable for indirect or consequential loss, lost profits, lost bookings, or travel decisions based on inaccurate information. This does not exclude liability that cannot lawfully be excluded, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence, breach of mandatory consumer rights, or other non-waivable rights.

No liability cap applies to consumers where a cap is prohibited by applicable law. Any otherwise applicable limitation operates only to the maximum extent permitted by law and does not restrict mandatory consumer remedies.

17. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts and applicable federal laws of the United States, without regard to conflict-of-law principles. This choice does not deprive a consumer of mandatory protections or court rights available under the law of the consumer's habitual residence.

Arbitration Agreement (US Users only): Except for an eligible small-claims action or a claim for urgent injunctive relief, you and WanderBunnies agree to resolve claims through individual, final, and binding arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules. You may opt out by emailing support@wander-bunnies.com within 30 days after first accepting these Terms and stating your name, account email, and decision to opt out. To the extent permitted by law, neither party may bring or participate in a class, consolidated, or representative arbitration.

Consumer Exceptions: A consumer may benefit from mandatory protections and may bring proceedings in a court with jurisdiction under the law of the consumer's residence. Nothing prevents a consumer from using an applicable alternative dispute-resolution body or statutory complaint mechanism.
